Report of Children With Disabilities
Receiving Special Education on December 1, 2006 |
Under
the provisions of Part B of the Individuals With Disabilities Education Act
(IDEA), as amended, local education agencies are required to make an
unduplicated count of students with disabilities receiving special education on
December 1 or the closest school day to December 1.
Data
should be submitted to the Department of Education no later than Friday,
December 8, 2006. Inaccurate reporting of student data may result in loss of
funding or overpayments to localities.
There
are three new reporting requirements for this year:
1. Students must be reported using the State
Testing Identifier (STI) beginning with the December 1, 2006, child count. All students with disabilities, including
pre-school age students, students attending private schools and students who
are home instructed and receiving special education services from a local
school division must have this STI. When
two school divisions find it necessary to report the same student, they must
use the same STI.
2. School divisions will now report the amount
of time a special education student spends in the regular education
classroom. The time reported is the
total time in the regular class regardless of whether the student is receiving
special education or regular education.
3. The Limited English Proficiency (LEP)status of students with disabilities must also be reported
for those students who have Limited English Proficiency (LEP) status.
A
properly developed individualized education program (IEP) or a services plan
for students unilaterally placed by parents in private schools, but who are
receiving some special education, must be implemented for each disabled student
reported to the Virginia Department of Education.
Because
these data form the basis for state funding and federal reporting, information
submitted is subject to audit by the United States Department of Education, the
Virginia Department of Education, and the Auditor of Public Accounts.
Therefore, documentation of age and disability for students reported must be
maintained at the local level.
