| SUBJECT: | Notice from Parent or Parent's Attorney Requesting a Due Process Hearing |
Public Law 105-17, Amendments to the Individuals with Disabilities Education Act (IDEA), requires each state educational agency to develop a model form to assist parents in filing requests for due process hearings. (See ~615 (b)(8)) Attached is a copy of the Department's model form for school divisions to provide parents when requests are made for a due process hearing. We recommend that this form be duplicated on NCR (non-carbon required) paper so that copies may be retained by the local superintendent, special education director, and parent. A copy of this form also may meet the requirements that local school divisions submit a copy of the written request for a due process hearing to the Department. (See ~3.4, A.7(b) of the Regulations Governing Special Education Programs for Children with Disabilities in Virginia) Questions about this memorandum may be referred to Judy Douglas, Associate Director, Special Programs, Division of Compliance.
