SUPTS. MEMO. NO. 146
September 26, 1997

INFORMATIONAL

TO: Division Superintendents
FROM: Richard T. La Pointe
Superintendent of Public Instruction
SUBJECT: Notice from Parent or Parent's Attorney Requesting a Due Process Hearing

Public Law 105-17, Amendments to the Individuals with
Disabilities Education Act (IDEA), requires each state
educational agency to develop a model form to assist parents
in filing requests for due process hearings. (See ~615 (b)(8))

Attached is a copy of the Department's model form for school
divisions to provide parents when requests are made for a due
process hearing.  We recommend that this form be duplicated on
NCR  (non-carbon required) paper so that copies may be
retained by the local superintendent, special education
director, and parent. A copy of this form also may meet the
requirements that local school divisions submit a copy of the
written request for a due process hearing to the Department.
(See ~3.4, A.7(b) of the Regulations Governing Special
Education Programs for Children with Disabilities in Virginia)

Questions about this memorandum may be referred to Judy
Douglas, Associate Director, Special Programs, Division of
Compliance. Dr. Douglas can be reached at 804-225-2771; or
  e-mail "jdouglas@pen.k12.va.us".
