SUBJECT:

English Language Proficiency Assessments for Limited English Proficient Students to Meet the No Child Left Behind Act of 2001 Requirements

Section 1111 (b) (7) of the No Child Left Behind Act of 2001 (NCLB) requires that local education agencies conduct an annual English Language Proficiency (ELP) assessment of limited English proficient students. For the 2007-2008 school year, school divisions may choose an ELP assessment that has been previously approved by the Virginia Board of Education listed in Attachment A; or submit a locally developed or selected assessment aligned to Virginias ELP Standards of Learning (SOL). For the 2007-2008 school year, payment for the ELP assessment will be the responsibility of school divisions.

A list of criteria and detailed information for submitting locally developed or other ELP assessments not previously approved by the Virginia Board of Education is in Attachment B. The divisions proposed ELP assessment and required documentation must be submitted to the Virginia Department of Education by October 19, 2007, using the required cover sheet provided in Attachment C. A panel will evaluate the assessment and present recommendations to the Board of Education for final approval.

If you have questions or need additional information, please contact the Division of Student Assessment and School Improvement by e-mail at Student_Assessment@doe.virginia.gov or by telephone at (804) 225-2102.
