Use of
Title I, Part A, Funds Under the No
Child Left Behind Act of 2001 |
The purpose
of this memorandum is to remind school divisions of two requirements related to
the use of Title I, Part A, funds. The first requirement is the restriction of
using Title I funds to supplement, not supplant other funds. As required under Section 1120A(b)of
the No Child Left Behind Act of 2001,
school divisions shall only use federal funds received under Title I, Part A,
to supplement the funds that would, in the absence of such federal funds, be
made available from non-federal sources for the education of pupils
participating in programs under this part, and not to supplant such funds.
The second
requirement is the limitation for use of Title I funds in Title I schools. As
required under Section 1113(a)(1) of the No
Child Left Behind Act of 2001, a local educational agency shall use funds
received under Title I, Part A, only in eligible school attendance areas. This section prohibits school divisions from
using Title I funds in non-Title I schools.
