SUBJECT: Transmittal of "Statement of Administrative Impact & Project Costs of Implementation" for the Proposed Revisions to the Regulations Governing Pupil Transportation

As part of its responsibility for promulgating new regulations or revisions to existing regulations, the Virginia Board of Education is required to develop a statement of the administrative impact and projected cost to school divisions of implementing and complying with such regulations. The Board and the Virginia Department of Education are required to send a copy of the statement to each division superintendent (See § 22.1-17 of the Code of Virginia).

§ 22.1-177 of the Code states the Board may make regulations relating to the construction, design, operation, equipment, and color of public school buses and shall have the authority to issue an order prohibiting the operation on public streets and highways of any public school bus which does not comply with such regulations.

The Board of Education is in the process of revising its Regulations Governing Pupil Transportation. The proposed revisions will be published in the August 17, 2009, edition of the Virginia Register of Regulations, Volume 25, Issue 25. This document includes all proposed changes to the regulations.

The regulations define policies and procedures to be used by school divisions when transporting children. They set the minimum standards necessary for each school division in the Commonwealth to provide transportation for students. There will be minimal administrative impacts based on the proposed changes to these regulations.
