The purpose of this memo is to provide additional information regarding the Guidelines for Determining English Language Proficiency (ELP) Levels for Limited English Proficient (LEP) Students as outlined in Superintendent’s Memo No. 109-10. The earlier guidelines failed to specify Assessing Comprehension and Communication in English State-to-State for English Language Learners (ACCESS for ELLs®) scores to determine that a kindergarten student was proficient.
Beginning in August 2010, the calculations for Annual Measureable Achievement Objectives (AMAO) 2 (proficiency) will be determined based upon the results from the statewide administration of the ACCESS for ELLs® test, to include kindergarten LEP students. Consistent with the Final Title III Interpretations dated October 2008, a body of evidence can no longer be used in conjunction with the ELP assessment results to determine AMAO 1 (progress) and AMAO 2 (proficiency) calculations. In order for kindergarten LEP students to be identified as proficient and to be classified in Level 6, 1st Year (Formerly LEP) or Level 6, 2nd Year (Formerly LEP), the student must attain an Accountability Proficiency Level composite score of five or above and a literacy score of five or above.
