As part of its responsibility for promulgating new regulations or revisions to existing regulations, pursuant to § 22.1-17 of the Code of Virginia, the Board of Education (Board) is required to develop a statement of the administrative impact and projected cost to school divisions related to implementing and complying with such regulations. In addition, the Board and the Department of Education are required to send a copy of the statement to each division superintendent.
The Board is in the process of revising the Regulations Governing Driver Education, 8VAC20-340-10 et seq. and repealing the Regulations Governing the Approval of Correspondence Courses for Home Instruction, 8VAC20-60-10 et seq.
The 2008 General Assembly adopted amendments that removed the requirement in § 22.1-254.1 of the Code of Virginia for the Superintendent of Public Instruction to approve correspondence courses for parents who home school their children. As a result of this action, the Regulations Governing the Approval of Correspondence Courses for Home Instruction would no longer be necessary – except that § 22.1-205 of the Code requires that the Board approve correspondence courses for driver education, and that provision of the law was not changed.
Instead of maintaining two sets of regulations related to driver education, one governing correspondence courses specifically for driver education, and another governing driver education more generally, this proposal would simply add a new section about driver education correspondence courses to the Regulations Governing Driver Education and repeal the Regulations Governing the Approval of Correspondence Courses for Home Instruction.
There will be minimal fiscal or administrative impact based on the proposed changes to the Regulations Governing Driver Education or the repeal of the Regulations Governing the Approval of Correspondence Courses for Home Instruction.
