SUBJECT: Reallocation of 2016-2017 Title III, Part A, Unused Funds under the Elementary and Secondary Education Act of 1965 (ESEA)

Section 3114(c) of the Elementary and Secondary Education Act of 1965 (ESEA) requires the reallocation of unused Title III, Part A, Limited English Proficient (LEP) award funds to school divisions in accordance with criteria established by the state educational agency (SEA).  Section 3114(c) also requires that the SEA establish procedures for the reallocation of Title III, Part A, unused funds. Attachment A provides the reallocations of unused 2016-2017 (Federal Fiscal Year 2016) Title III funding to eligible school divisions.  Attachment B outlines the procedures the Department uses to calculate these reallocations.  Please note that the reallocation does not apply to 2016-2017 supplemental Immigrant Children and Youth (IY) funds.

Divisions receiving an LEP award of less than $10,000 and participating in the 2016-2017 Title III Statewide Consortium:

As a condition of participating in the Title III Statewide Consortium, participating divisions receive an adjusted Title III allocation as described in Superintendent’s Memo # 231-16.

Participating divisions should note that the Revised 2016-2017 LEP Award column in Attachment A does not reflect the final adjusted reallocation provided to these divisions through consortium membership.  Participating divisions should refer to the Title III statewide consortium webpage for final adjusted LEP awards.  Please see the 2016-2017 tab in the Consortium Documents folder.

Divisions receiving an LEP award of at least $10,000:

Divisions with an approved 2016-2017 individual or consolidated application in the Online Management of Educational Grant Awards (OMEGA) system in the Single Sign-On for Web Systems portal must submit an amendment to the Title III application through OMEGA reflecting their 2016-2017 reallocated LEP award funding amount as shown in Attachment A.

Divisions receiving an award of less than $10,000 and participating in an independent Title III consortium in 2016-2017:

For divisions participating in an independent Title III consortium with an approved 2016-2017 Title III application in OMEGA, the division serving as the fiscal lead on behalf of consortium members must submit through OMEGA an amendment to the approved Title III application reflecting their total 2016-2017 reallocated LEP award for the consortium.
