ADMINISTRATIVE

  The Emergency Immigrant Education Program is funded under
  the Emergency Immigrant Education Act of 1984 as amended by
  the Improving America's Schools Act of 1994 (Public Law 103-382,
  enacted October 20, 1994).  Funds will be allocated to
  school divisions based on the number of eligible children
  and youth enrolled in public and nonpublic elementary and
  secondary schools.

  The definition of "immigrant children and youth" in
  accordance with Section 7501 (7) of the Improving America's
  School Act means individuals  who are aged 3 through 21,
  were not born in any State, and have not been attending one
  or more schools in any one or more States for more than 3
  full academic years.

  Regulations require each school division to make a count of
  immigrant children.  The established date for this count is
  April 1, 1997.  To be eligible to receive funds under this
  grant, a school division must have at least 500 immigrant
  children enrolled or 3% of the total number of students
  enrolled in elementary and secondary public and non-public
  schools served by the school divisions.  All school
  divisions are requested to return the attached Emergency
  Immigrant Program Form, even if they do not meet the
  criteria for the grant funds. 

  Please return the completed form to Mrs. Leigh H. Williams,
  Budget Analyst, Department of Education, P. O. Box 2120,
  Richmond, Va. 23218-2120, on or before April 11, 1997 to
  enable us to meet the Federal due date of May 15, 1997.
