SUBJECT: Survey of Private Nonprofit Schools

Due: February 21, 2003


The Elementary and Secondary Education Act of 1965, as amended by the No Child Left Behind Act of 2001, provides in Section 9501 of Title IX and Section 5142 of Title V, Part A, that private nonprofit elementary and secondary schools are eligible to participate in several programs authorized under the act. Each school division is obligated to inform private school officials within the divisions attendance area that private nonprofit schools are eligible to participate in the following programs: Title III Language Instruction for Limited English Proficient and Immigrant Students; Title IV, Part A - Safe and Drug-Free Schools; and Title V, Part A - Innovative Programs. Each school division is responsible for ascertaining the number of students enrolled in private schools eligible to participate in these programs. These enrollments will be used for the purpose of distributing 2003-2004 entitlements for Title III; Title IV, Part A; and Title V, Part A. The Title I data collection is for informational purposes only.


New this year is the collection of enrollment information from private nonprofit schools for the Title III Language Instruction for Limited Proficient and Immigrant Students program. Also, please note that enrollment data for Title II, Part A Teacher and Principal Training and Recruiting Fund will not be collected this year. These data are no longer used in the entitlement calculation for the program, but private nonprofit schools are still eligible to participate in local staff development activities associated with Title II, Part A.


School divisions are required to submit the necessary data to the Department of Education using an Excel template. All school divisions are required to submit the Excel template and a certification from the division superintendent. A check box is supplied in the Excel template for school divisions to indicate that there are no private schools to survey within the division boundary if applicable. The following attachments to this memorandum provide detailed instructions and forms for collecting and submitting the 2001-2002 school year enrollment data to be used to compute the program entitlements for the 2003-2004 school year:


Attachment A This attachment provides detailed instructions for accessing the Excel template. Instructions for using the template to collect and submit the 2001-2002 school year enrollment data are included in the template.


Attachment B The Private Nonprofit School Intent to

Participate form may be duplicated as needed and used to collect participation data from each private nonprofit school located in your division. It is suggested that the form be sent to private nonprofit schools by registered mail. The record of mail certification and delivery should be maintained by the school division. The due date for this form to be returned to the appropriate school division is January 31, 2003.


Please complete the Excel template and e-mail it to the department at no later than February 21, 2003. The division superintendents certification is also due to the department by February 21, 2003, and should be mailed to the Virginia Department of Education, Budget Office, P. O. Box 2120, Richmond, Virginia 23218-2120. Entitlement allocations cannot be accurately determined for any school division until all divisions have returned the required participation data.
